Licensing Terms & Conditions

Developer License - (DL) - Grant of License

DMXReady grants the licensee the following rights regarding the use of applications sold with a Developer License (DL):

  1. The licensee IS GRANTED "unlimited usage" of this application in "multiple web sites" for as long as the terms and conditions of this agreement are followed.
  2. The licensee MAY distribute or "re-sell" the application to clients and/or owners of websites which the licensee has directly designed, coded, or otherwise created, for the sole use of that website.
  3. The licensee MAY rewrite, edit, add, delete, or otherwise customize any aspect of the application or its script as is deemed necessary by the licensee.
  4. The licensee MAY distribute or "private label" the application to any clients, website owners, or any person(s) for which the licensee has directly designed, coded, or otherwise created a website.

DL Restrictions:

  1. The licensee MAY NOT distribute or "re-sell" the application independently of a website to any person(s).
  2. The licensee MAY NOT "private label" the application without substantial changes to the scripts and HTML code.
  3. The licensee MAY NOT distribute or "re-sell" the application in direct competition with DMXReady.

Single Site Licence - (SSL) - Grant Of License

DMXReady grants the licensee the following rights regarding the use of applications sold with a Single Site License (SSL):

  1. The licensee IS GRANTED "limited usage" of this application to a maximum of one (1) website or one (1) client.
  2. The licensee MAY distribute or "re-sell" this application to a single client and/or owner of a website which the licensee has directly designed, coded, or otherwise created, for the sole use of that website.
  3. The licensee MAY rewrite, edit, add, delete, or otherwise customize any aspect of the application or its script as is deemed necessary by the licensee, however any level of customization to the original application does not change in any way its status of "limited usage".

SSL Restrictions:

  1. The licensee MAY NOT distribute or "re-sell" the application in any form, EXCEPT as part of a single website design project that the Licensee is contracted to design/upgrade or otherwise develop.
  2. The licensee MAY NOT use the source code, in part or in whole, as part of new application without first upgrading to the Developer License (DL).

End Users Agreement

The use of any and all DMXReady Applications is governed by the following legal agreement. All use of DMXReady applications is conditional upon your compliance with the license terms that follow. If you do not agree to the terms of this license agreement, or do not comply with the terms and conditions of this agreement, you are not permitted to use this application and are required to remove all DMXReady Applications from your computer system and designed website(s), and destroy all copies. The use of any DMXReady Application constitutes your agreement to abide by the terms and conditions set out in this document.

DMXReady applications, herein called the "Application", is protected by International copyright laws. Upon your agreement to and compliance with the terms of this license agreement, DMXReady grants you , herein called the "Licensee", The following Non-Transferable, non-exclusive rights of use. DMXReady has the right to terminate this agreement if the "Licensee" fails to comply with any term or condition of this agreement. No title to the intellectual property in the application is transferred to you unless expressly set forth in the license.

Limitations Of Liability And Disclaimer Of Warranty

There are no warranty rights implied or otherwise granted to the licensee regarding the application. The application and accompanying written materials are supplied to the licensee "as is" without warranty of any kind. DMXReady does not guarantee, warrant, or make any representations, either expressed or implied, regarding the use, or the results of the use of the application or the written materials. The licensee assumes the entire risk as to the results and performance of the application.

DMXReady shall not be liable under any circumstances for any damages whatsoever arising out of the use, or the inability to use, the application.
